{"id":2253,"date":"2017-12-14T08:52:46","date_gmt":"2017-12-14T14:52:46","guid":{"rendered":"http:\/\/hkhlaw.org\/?p=2253"},"modified":"2017-12-14T08:52:46","modified_gmt":"2017-12-14T14:52:46","slug":"hkh-attorneys-obtain-favorable-rulings-for-clients","status":"publish","type":"post","link":"https:\/\/hkhlaw.org\/hkh-attorneys-obtain-favorable-rulings-for-clients\/","title":{"rendered":"HKH Attorneys Obtain Favorable Rulings for Clients"},"content":{"rendered":"<p>HKH\u2019s Labor and Employment Practice Group recently achieved summary judgment for its clients in three separate cases.<\/p>\n<ul>\n<li>In the first case, decided on \u00a0November 21, 2017, an optometrist under contract with a retailer claimed the retailer did not renew her contract on the basis of her race.\u00a0 The United States District Court for the Northern District of Alabama, however, agreed with HKH\u2019s evidence that the optometrist\u2019s contract was not renewed because she failed to fulfill certain contract terms.\u00a0 HKH attorney Lynlee Wells Palmer represented the retailer in securing the dismissal of the case.<\/li>\n<li>In the second case, decided on December 7, 2017, a retail employee claimed his employer discriminated against him on the basis of an alleged disability and retaliated against him for seeking an accommodation related to that condition.\u00a0 Representing the employer, HKH successfully argued that the employee had been fully accommodated.\u00a0 HKH attorney Jonathan S. Harbuck achieved dismissal for the retailer from the United States District Court for the Southern District of Alabama.<\/li>\n<li>In the third case, also decided on December 7, 2017, a nursing home employee claimed that her termination was based on her race, her age, her alleged disability, and in retaliation for an alleged complaint about her supervisor.\u00a0 Finding for the employer and dismissing the case, the United States District Court for the Northern District of Alabama concluded that the employee\u2019s discharge was based on her repeated and admitted documentation errors, not on any protected class or in retaliation for any complaint.\u00a0 HKH attorneys Spencer A.
