Attorneys Spencer Kinderman and Lynlee Wells Palmer have been selected as speakers for the 2016 Alabama Nursing Home Legal Compliance Seminar. Kinderman and Palmer’s presentation on “The Heavy Burden of Light Duty: Managing Light Duty under Worker’s Comp, the ADA, and the Pregnancy Discrimination Act” will address the many questions related to light duty assignments. What should/can you do with an employee who has physical restrictions preventing her from performing all of the functions of her job? The answer to that question is becoming increasingly complex as an ever-growing number of statutes address accommodations for injured, sick, or otherwise physically limited employees. Their program will address the overlapping nature of the various light duty/reasonable accommodation requirements, with particular emphasis on employers’ new light duty obligations for pregnant employees arising from the U.S. Supreme Court’s March 2015 opinion in Young v. UPS.
